1.- Definitions
1.1 Artwork: Any physical print, set, or edition produced under the Mari Prete Fineart® brand.
1.2 Limited Edition: A primary run of numbered Artworks, in a fixed quantity as stated in product descriptions.
1.3 Artist’s Proof: An additional, separate run outside the primary run, strictly limited in number.
1.4 Certificate of Authenticity (COA): A document issued to accompany each Limited Edition or Artist’s Proof that attests to its authenticity, edition size, and matching holographic sticker.
1.5 Holographic Sticker: A security label affixed to the Artwork bearing a unique serial number, produced by Advast Suisse AG.
1.6 Transfer of Ownership Form: A separate document used to record resale, gifting, or other legal transfers beyond the original purchaser.
2.- Certificate of Authenticity
2.1 Issuance
2.1.1 Each Limited Edition or Artist’s Proof Artwork is accompanied by one COA, issued by JM CROSSROAD S.L. (Mari Prete Fineart®), registered in Malaga, Spain (Reg. MA-172542; IRUS 1000049042563).
2.1.2 The COA is printed on archival, high-security paper and bears a digitally signed token verifiable via QR code or at verify.mariprete.art.
2.2 Contents
2.2.1 Artwork title, motif number, edition type, edition number, total edition size, and any Artist’s Proof count.
2.2.2 Matching holographic sticker serial number.
2.2.3 Issuance date, issuing entity, and official signature.
2.3 Validity
2.3.1 The COA is valid only when accompanied by the corresponding Artwork bearing the matching holographic sticker.
2.3.2 Any alteration, forgery, or removal of the holographic sticker or COA invalidates the certificate and releases JM CROSSROAD S.L. from all obligations.
3.- Holographic Sticker Security
3.1 Manufacturer: Advast Suisse AG, Switzerland.
3.2 Specifications:
– Round, silver, 35 mm diameter
– Swiss-cross motif, “GENUINE / ORIGINAL / AUTHENTIC” legends
– Nanotext (100× magnification), microtext, kinetic & 2D / 3D flip effects, spectral gradients, achromatic white, Fresnel effects
– 6-digit fluorescent serial number, visible only under UV light
3.3 Tamper Evidence: Any attempt at removal or alteration leaves visible damage; tampering voids COA validity.
4.- Edition Structure
4.1 Primary Run: The numbered prints or sets, in the total quantity advertised (e.g. 200).
4.2 Variants: Size or finishing options within the primary run; sum of all variant sub-limits equals the primary run.
4.3 Artist’s Proofs: Additional prints or sets outside the primary run, in a strictly limited quantity (e.g. 5 AP).
5.- Proof of Ownership
5.1 Legal Title
5.1.1 Passes to the purchaser upon full payment and delivery of the Artwork.
5.1.2 Is evidenced by (a) valid invoice, (b) matching COA, and (c) the Artwork bearing the holographic sticker.
5.1.3 The COA attests authenticity but does not itself convey legal title.
6.- Transfer of Ownership
6.1 Gifting, Resale & Bequests
6.1.1 Any subsequent transfer of title—whether by gift, sale, inheritance, or otherwise—must be documented via the official Transfer of Ownership Form.
6.1.2 The form records donor/seller, recipient, date, and signatures, and must be returned to Mari Prete Fineart® for archival.
6.1.3 The original COA remains unaltered; all transfers are logged separately to preserve provenance.
7.- Data Protection & Privacy
7.1 We comply with GDPR and all applicable global data-protection laws.
7.2 Personal data collected for COA issuance, provenance tracking, and transfers is used solely for those purposes and not shared without consent, except as legally required.
8.- Warranty & Liability
8.1 Authenticity Guarantee
8.1.1 Mari Prete Fineart® guarantees the authenticity of all Limited Editions and Artist’s Proofs.
8.2 Exclusions
8.2.1 No warranty is given for artwork condition; collectors should inspect prints upon receipt.
8.2.2 JM CROSSROAD S.L. is not liable for damage due to improper handling, unauthorized framing, or environmental factors.
8.3 Limitation of Liability
8.3.1 Our total liability is limited to the purchase price of the Artwork.
9.- Enforcement & Jurisdiction
9.1 These terms are governed by Spanish law.
9.2 Any dispute shall be submitted to the exclusive jurisdiction of the courts of Malaga, Spain.
